Thank you for your interest in our Product Registration. Data protection is extremely important to our Product Registration team at Beurer North America, L.P., a Delaware limited partnership (“Beurer North America”, “us”, “our” or “we”). By participating in our Product Registration, you will provide certain personal data to Beurer North America through our Product Registration website. By providing personal data through our product registration page, you are consenting to the processing of your personal data by us. By providing additional personal data to us through our website after your initial registration for the Product Registration, you thereby consent to our use of such personal data.

Beurer North America, as the person controlling the processing of personal data for our Product Registration, has implemented certain technical and organizational measures to protect the personal data that your submit to us. 2. Collection and storage of personal data and nature and purpose of its use

a) Use of the Product Registration website:

When you use the Product Registration website, the web browser that you use on your end device automatically transmits information to the server. This information is stored temporarily in what is known as a log file. The following information is collected without any action on your part, and stored until it is automatically deleted:

  • date and time of access;

  • name and URL of file accessed;

  • IP addresses;

  • website from which the information was accessed (referrer URL);

  • browser used and possibly your computer's operating system and the name of your access provider.

We process this data for the following purposes:

  • to ensure a seamless connection to the website can be established;

  • to ensure convenient use of our website;

  • to evaluate system security and stability; and

  • for other administrative purposes.

Our legitimate interest arises from the purposes outlined above for data collection and ensuring the functional reliability of our website. We may use the data that we collect for marketing purposes and for generally drawing conclusions about you. The data will be stored for 12 months, subject to legal obligations and considerations.

b) Registration data

When you register for the Product Registration, we collect personal data including, but not limited to:

  • Name;

  • Mailing address;

  • Phone number;

  • Email address;

  • Product number;

  • Details of your registered product, such as the name of the product, the product category it belongs to, the product model number, and date of purchase;

  • Other personally identifiable information.

 

If you have explicitly consented for us to do so, we will use your email address to regularly send you offers and other information for marketing purposes. Providing us with an email address is sufficient consent for us to send to you such offers and information.  You can unsubscribe at any time, for example by using the link provided at the end of each email sent to you. Alternatively, you are also welcome to email an unsubscribe request to unsubscribe@beurer.com at any time. You will receive such offers and materials only until you revoke consent. You have the right to revoke your future consent at any time. You may subsequently receive one or more emails of offers or information from us for technical reasons.

 

The purpose of the data collection is to maintain our Product Registration database and to contact you with promotions and other materials. We may analyze all information associated with your personal data to adapt the communications to your preferences and behavior and to provide you with a more personalized experience. We also use this information to monitor the success of our marketing efforts.  The data will be stored for 12 months, subject to legal obligations and considerations.

You may contact us through our website to submit a question or to submit a request. Should you do so, the following data will be collected:

  • country; and

  • email address.

You may also choose to share further data with us.

 

The purpose of such data collection is to respond adequately to your questions.
The data will be stored for 12 months, subject to legal obligations and considerations.

3. Disclosure of data

Within Beurer North America and Buerer GmbH, entities that require, or reasonably request, access to data to fulfil contractual and legal obligations receive access to the data.  Beurer North America's external service providers may also receive this data. These service providers may be:

  • affiliated companies, where these are required for the fulfilment of contracts, including warranty contracts;

  • service providers for processing customer service questions, warranty processing, marketing intelligence, data analysis, website hosting, auditing, information technology, customer service, email service, fraud prevention and other services;

  • IT service providers, hosting service providers, and service providers for operating the IT system;

  • Service providers for dissemination of our marketing materials, upon your consent.

We may also use or disclose your personal data as we deem to be necessary to comply with applicable laws and cooperate with law enforcement or for other legal reasons; to enforce our terms of use or other policies; and to protect our rights, safety or property, and that of others.  We may also disclose your personal data to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by us about our website users is among the assets transferred.

4. Cookies

Our Product Registration website uses cookies. Cookies are text files which are transmitted to a computer system via an internet browser and stored there.  Your web browser may have a setting that prevents cookies from tracking your use of websites; however, we are not able to respond directly to “do not track” requests.

5. Rights of the data subject

You have the right to:

  • request information about your personal data that we process.   • request the erasure of personal data relating to you stored by us, unless processing is required for the exercising of the right to freedom of expression and information, for compliance with a legal obligation, for reasons of the public interest, or for the establishment, exercise, or defense of legal claims;

  • request the restriction of processing of your personal data in the event that you decline its erasure and we no longer need the data but you require it for the establishment, exercise, or defense of legal claims;

  • receive the personal data relating to you that you have provided to us in a structured, established, and machine-readable format, or to request the transfer of the same to another controller;

  • at any time revoke any consent you have provided to us, which will result in us no longer continuing to process the data to which this consent relates, and

  • lodge a complaint to a supervisory authority.

6. Right to object

If your personal data is processed based on legitimate interests you may submit an objection to the processing of your personal data if there are reasons to do so arising from your particular situation, or if the objection relates to direct advertising. In the latter case, you have a general right to object, which we will implement without requiring a particular situation to be stated.

If you would like to exercise your right to revoke consent or to object, it is sufficient to send an e-mail to unsubscribe@beurer.com to do so.

7. Data security

During your visit to our website, we generally use SSL (Secure Socket Layer) process in conjunction with the highest level of encryption supported by your browser. This is generally 256-bit encryption. If your browser does not support 256-bit encryption, we will use 128-bit v3 technology instead. You can verify that information is being transmitted in encrypted format on the individual pages of our website by checking for the closed padlock icon in the bottom status bar of your browser.

We also use certain technical and organizational security measures intended to protect your data against accidental or intentional manipulation, partial or full loss, destruction or unauthorized access by third parties. Our security measures may be modified in line with technological developments.

8. Obligation to make data available

In the context of using the Product Registration website, you are required to make available personal data that is essential for service provision. Without this data, we are not able to provide the service.

 

9.  Children Under the Age of 13

 

Our website and the Product Registration are not intended for children under 13 years of age. No one under age 13 may provide any information to or on our website. We do not knowingly collect personal information from children under 13. If you are under 13, do not use or provide any information on our website or on or through the Product Registration or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information.
